Local regulations for hosting in Tübingen
For individuals hosting homes in the City of Tübingen, this article provides targeted information on applicable local regulations. It is imperative, as stipulated by the OH-Stay.com article "Hosting in Germany," that hosts independently verify and adhere to all relevant obligations. While this document serves as a foundational reference, it is neither exhaustive nor a substitute for professional legal or tax counsel. Hosts are advised to regularly confirm the timeliness of all laws and procedures. Should complexities arise, direct engagement with the City of Tübingen or a local advisor (e.g., an attorney or tax professional) is recommended.
Short-term rental regulations
The Statute on the Prohibition of Misappropriation of Residential Space in the City of Tübingen (Satzung über das Verbot der Zweckentfremdung von Wohnraum in der Stadt Tübingen) governs the use of residential property and prohibits the use of living space for unauthorized purposes. This statute specifically addresses home sharing, including short-term rentals in Tübingen, and contains different rules depending on the type of accommodation you offer.
Registration obligations
Since 22 March 2022, every Host sharing residential space on a short-term basis in Tübingen must obtain a registration number and display it in the respective listing.
You can obtain this registration number from the City of Tübingen by registering your rental activity before renting for the first time.
Once obtained, add your registration number to your OH-Stay.com listing by following these steps:
-
Go to Listings and select the listing for which you wish to add the registration number.
-
Go to Policies and Rules and scroll to the section Laws and Regulations.
-
Next to Regulations, click Edit.
-
Under Add a permit number, click Add.
For further information, contact the Tübingen authorities or the Tübingen housing department regarding registration obligations.
Time limits
There is no time limit for renting if you rent out less than 50% of your residential space. If you rent more than 50% of your residential space, you may do so for up to 10 weeks per calendar year with a registration number. For hosting beyond 10 weeks per year, you must apply for a permit.
Permit obligations
According to the statutes, renting more than 50% of residential space on a short-term basis for more than 10 weeks per year generally requires a permit from the Tübingen authorities.
Non-residential space
The statutes only apply to short-term rentals of residential space. Other types of space, such as commercial premises, hotels/hostels, or other non-residential properties, are not subject to these rules and do not require a permit or registration number.
