Local regulations for hosting in Potsdam

For individuals hosting homes in the City of Potsdam, this article provides targeted information on applicable local regulations. It is imperative, as stipulated by the OH-Stay.com article "Hosting in Germany," that hosts independently verify and adhere to all relevant obligations. While this document serves as a foundational reference, it is neither exhaustive nor a substitute for professional legal or tax counsel. Hosts are advised to regularly confirm the timeliness of all laws and procedures. Should complexities arise, direct engagement with the City Administration of the State Capital Potsdam or a local advisor (e.g., an attorney or tax professional) is recommended.

Short-Term Vacation Rental (STVR) Regulations

In Potsdam, specific regulations govern short-term rentals and other uses of residential spaces, which can affect you as a Host. Renting out your primary residence or a vacation home may be restricted and subject to conditions and time limits. A bylaw prohibiting the misuse of residential space came into force in April 2021.

Housing

Under Potsdam’s regulations, any space that is both legally and practically suitable for permanent residential use is considered living space. Residential spaces can include apartments or individual living rooms. Premises built for non-residential purposes and used accordingly are excluded from these regulations.

Permitted short-term rental

Residential spaces can be used for short-term rental without a permit if less than 50% of the space is rented out. Individual rooms covering less than half of the living space can be rented without authorization. Renting your home for short-term stays is allowed for up to eight weeks per calendar year.

Permit obligations

Short-term rentals beyond the exemptions described above require a permit, which is issued by the State Capital Potsdam.

A permit may be granted if overriding public interests or private interests worthy of protection outweigh the interest in preserving the residential space.

Additionally, a permit can be approved if compensatory measures effectively mitigate the impact on residential preservation, for example by providing replacement housing or making a compensatory payment. Permits may be granted for a limited time and may include specific conditions.

Application forms and city services

Further information is available on the website of the City Administration of the State Capital Potsdam. There, you can access the forms required for registration and informative leaflets to assist with any questions.
