Local regulations for hosting in Stuttgart

For individuals hosting homes in the City of Stuttgart, this article provides targeted information on applicable local regulations. It is imperative, as stipulated by the OH-Stay.com article "Hosting in Germany," that hosts independently verify and adhere to all relevant obligations. While this document serves as a foundational reference, it is neither exhaustive nor a substitute for professional legal or tax counsel. Hosts are advised to regularly confirm the timeliness of all laws and procedures. Should complexities arise, direct engagement with the City of Stuttgart or a local advisor (e.g., an attorney or tax professional) is recommended.

Short-term rental regulations

Stuttgart's Zweckentfremdungsverbotssatzung (ZwEVS) is a statute that prohibits the use of living space for unauthorized purposes and governs the use of residential property. The statute explicitly addresses home sharing, including short-term rentals in Stuttgart. Different regulations may apply depending on the type of accommodation you offer.

Registration obligations

Since 2 July 2021, every individual sharing residential space on a short-term basis in Stuttgart must obtain a registration number and display it in the respective listing.

You can obtain this registration number from the City of Stuttgart by registering your rental activity before renting for the first time.

To register, you must provide the following information:

  • Name, address, and date of birth

  • Information on the location of the living space (street and house number)

  • A location sketch

  • Confirmation of the right in rem to the affected living space

  • A floor plan of the apartment

Once obtained, enter your registration number in the appropriate field in your OH-Stay.com listing by following these steps:

  1. Go to Listings and select the listing for which you wish to add the registration number

  2. Go to Policies and Rules and scroll down to the section Laws and Regulations

  3. Next to Regulations, click Edit

  4. Under Add a permit number, click Add

For further official information about registration obligations, see the online registration tool of the City of Stuttgart. If you have questions, contact the Stuttgart housing department via email or by phone (+49 (0)711 21660681).

Time limits

There is no time limit for renting if you rent out less than 50% of your residential space. If you rent more than 50% of your residential space, you may do so for up to 10 weeks per calendar year with a registration number. For hosting beyond 10 weeks, you must apply for a permit.

Permit obligations

According to the ZwEVS, renting more than 50% of residential space on a short-term basis for more than 10 weeks per year generally requires a permit from the Stuttgart authorities.

If you wish to rent out your primary residence on a short-term basis as a private host, the statute generally allows you to obtain a permit. More information about obtaining a permit is available on Stuttgart’s official website.

Non-residential space

The ZwEVS only applies to short-term rentals of residential space. Other types of space, such as commercial premises, hotels/hostels, and other non-residential properties, are not subject to these rules and do not require a permit or registration number.
