Local Regulations

Most short-term accommodations in Romania must hold a classification certificate issued by the Ministry of Economy, Entrepreneurship and Tourism. Official instructions are available on the Ministry’s portal: “Certificat de clasificare” at turism.gov.ro and the e-services portal at se.situr.gov.ro.

National taxes

Tax is a complex topic. Your obligations vary based on your circumstances, so please research your duties or consult a qualified tax professional.

In general, money you earn as a host on OH-Stay.com is taxable income and may be subject to personal income tax and, in some cases, VAT (TVA). The ANAF pages for individuals cover personal income tax at [financnasprava.sk — not applicable] (use Romania’s ANAF resources instead): see ANAF – Declara?ia Unic? (Formular 212) at anaf.ro. Annual filing for 2025 income is typically due by 25 May (or the next working day; for 2025, 26 May 2025), per ANAF notices such as the deadline circulars and county communications (e.g., “termenul… 26 mai 2025”). Regulations and Permissions

It’s important to make sure you’re allowed to host on your property. Restrictions can arise from contracts, laws, and community rules. Use the notes below as a starting point and seek legal advice if needed.

Displaying the classification certificate
Hosts are required to obtain a physical classification certificate from the Ministry and display it prominently (e.g., entrance hall and kitchen, if provided). Application instructions and forms are provided by the Ministry: see the classification page at turism.gov.ro and online submission via se.situr.gov.ro.

Displaying the Ministry control phone number
Current contact details for Direc?ia General? Turism – Direc?ia Control are listed on the Ministry’s Contact page at turism.gov.ro/web. Print and display the number published there in a visible place in the property (e.g., entrance hall and kitchen).

Contractual agreements and permits
Leases, building regulations, and association by-laws may restrict subletting or hosting. Review your agreements and, where appropriate, seek consent (e.g., asocia?ia de proprietari/locatari).

Mortgage restrictions
If your property has a mortgage, confirm with your lender that hosting is permitted.

Subsidized housing restrictions
Social/subsidized housing typically restricts subletting without prior authorization. Check with your housing authority or association.

Neighbours
To obtain (and keep) classification, you may need owners’ association approval or neighbour consent (those sharing common walls horizontally and vertically). Check local requirements and keep written proof when applicable.

Housemates
Consider a written housemate agreement covering hosting frequency, guest etiquette, and revenue sharing.

EU consumer protection law

Misuse

Safety

Medical supplies
Keep a first-aid kit, tell guests where it is, and restock regularly.

Fire prevention
If you have gas appliances, follow applicable gas-safety rules and install a carbon monoxide detector. Provide and maintain a fire extinguisher.

Post a clearly marked fire-escape route.

Hazard prevention
Inspect for trip/fall hazards; remove or mark them. Fix exposed wires; ensure stairs have railings; secure dangerous items.

Child safety

Explain building and neighborhood parking rules (assigned spaces, street-cleaning times, overnight limits).

Pets
Check lease/building rules. If allowed, share local exercise areas and waste-disposal guidance, plus a nearby kennel as a backup.

Privacy
Respect guest privacy. Be transparent about any permitted security devices and comply with applicable laws.

Smoking
If prohibited, post clear signage. If allowed, provide ashtrays in designated areas.

Insurance

Work with your insurer to confirm obligations, limits, and coverage suited to hosting. Some policies do not cover guest-caused damage or loss—review your terms carefully.
