Short-Term Rental Regulations

Freiburg enforces the Satzung über das Verbot der Zweckentfremdung von Wohnraum in der Stadt Freiburg im Breisgau, a statute that prohibits using residential space for unauthorized purposes. This includes regulations on home sharing and short-term rentals. Rules differ depending on the type of accommodation offered.

Registration Obligations

Since January 1, 2022, every host sharing residential space on a short-term basis in Freiburg must obtain a registration number and display it in the listing.

To register:

  • Obtain your registration number from the City of Freiburg before renting for the first time.

  • Add the registration number to your OH-Stay.com listing by going to Listings, selecting the listing, navigating to Policies and rules → Laws and regulations, and clicking Add permit number.

Time Limits

  • If you rent out less than 50% of your residential space, there is no time limit.

  • If you rent more than 50% of your residential space, you can do so for up to 10 weeks per calendar year with a registration number. Hosting beyond 10 weeks requires a permit.

Permit Obligations

Hosts renting out more than 50% of residential space for over 10 weeks per calendar year generally need a permit from the Freiburg authorities. Renting your primary residence on a short-term basis as a private person is usually eligible for a permit. More details are available on Freiburg’s official website.

Non-Residential Space

The statutes only apply to residential spaces. Commercial spaces, hotels, hostels, or other non-residential accommodations do not require a permit or registration number.
