AFFILIATE PROGRAM POLICY

OH-Stay.com Affiliate Program

Welcome to the OH-Stay.com Affiliate Program. Our program allows partners (“Affiliates”) to earn commissions by referring new guests or hosts to our platform. By participating, you agree to comply with the terms set forth below.

 

1. Eligibility & Enrolment

Application

All Affiliates must apply through our official portal. We reserve the right to reject applications from sites or individuals that promote adult content, violence, discrimination, or illegal activities.

Verification

To comply with EU tax reporting obligations (including DAC7 and UK Digital Platform Reporting rules), Affiliates are required to provide the following before receiving any payouts:

● Full legal name (or registered business name)

● Primary address

● Date of birth (for individuals)

● Tax Identification Number (TIN) and country of issuance

● VAT registration number (if applicable)

● IBAN or other payment account identifier

OH-Stay cannot process affiliate payouts until this information has been provided and verified. For further information on what this means and why it is required, please refer to our DAC7 FAQs document, available at oh-stay.com/help/dac7-faq.

 

2. Commission Structure & Payouts

Qualified Referrals

A “Qualified Referral” occurs when a new user clicks your unique affiliate link and completes a “Qualifying Stay” — meaning the guest has checked out and the booking was not subsequently refunded, cancelled, or chargebacked.

Commission Rates

● 20% of the OH-Stay.com service fee on each booking made by the referred guest.Guest Referral:

● 20% of the OH-Stay.com service fee on each booking received by the referred host.New Host Listing:

Each reward is paid on all ongoing bookings for a period of 12 months from the date of the Qualified Referral.

Worked example: A guest books a property for €1,000. OH-Stay’s service fee is 10% (€100). The affiliate earns 20% of €100 = €20 for that booking. If the same guest books again within 12 months, the affiliate earns again on that booking.

Commission Calculation on Bidding

If a guest referred by an affiliate makes an offer through OH-Stay’s bidding feature and the offer is accepted at a price different from the listing price, the affiliate commission is calculated on the OH-Stay service fee applied to the actual accepted booking value — not the original listing price.

Cookie Duration

Our tracking cookies last for 30 days. If a user makes a booking within 30 days of clicking your affiliate link, the referral is attributed to you (last-click attribution).

Payout Schedule

Commissions are processed 30 days after the end of the month in which the guest completed their stay. This delay ensures the booking was not subsequently refunded or chargebacked.

Chargebacks & Clawbacks

If a booking on which commission was paid is subsequently refunded, cancelled, or chargebacked, OH-Stay reserves the right to deduct the corresponding commission from your future affiliate payouts. If your affiliate account has a negative balance due to clawbacks, payouts will be suspended until the balance is cleared by future commissions.

Service Fee Changes

Affiliate commissions are always calculated on the OH-Stay service fee rate in effect at the time of the booking, not at the time the referral was originally made. If OH-Stay adjusts its service fee percentage, your commission percentage (20%) remains the same, but the base amount it applies to may change.

 

3. Promotion & Marketing Guidelines

To protect our brand and ensure a fair ecosystem, Affiliates must adhere to the following:

Transparency (FTC/ASA Compliance)

You must clearly disclose your affiliate relationship to your audience. Disclosures must be “clear and conspicuous” and appear before any affiliate links are presented. Examples of compliant disclosures are provided in Section 7 of this policy.

Search Engine Marketing (PPC)

Affiliates are prohibited from bidding on OH-Stay brand keywords (including “OH-Stay”, “OH Stay”, “OhStay”, “oh-stay.com”, or misspellings and variations thereof) on Google, Bing, or any other search engine or advertising platform.

Spam & Ethical Conduct

No mass emailing (spamming), forced clicks, cookie stuffing, or use of bots. All traffic must be organic or through approved paid social media channels. Affiliates must not use pop-unders, browser toolbars, or adware to generate clicks.

Accuracy

You may not misrepresent the price, availability, features, or cancellation policies of any listing. You may not make claims about OH-Stay’s services that are not substantiated by our official website or marketing materials.

 

4. Prohibited Actions

Failure to comply with these rules will result in immediate termination from the program and forfeiture of all unpaid commissions:

● You cannot earn commissions on your own bookings or your own property listings.Self-Referrals:

● You may not register domains containing “OH-Stay”, “OhStay”, or similar variations.Domain Squatting:

● You may not create social media accounts that appear to be official OH-Stay profiles.Social Media Impersonation:

● You may not use the OH-Stay logo, brand name, or other brand assets in a way that implies endorsement, employment, or official partnership beyond the affiliate relationship.Trademark Misuse:

● You may not offer cashback, rebates, or other financial incentives to users for clicking your affiliate link or making a booking, unless expressly approved by OH-Stay in writing.Incentivised Traffic:

 

5. Tax Reporting — DAC7 & UK Digital Platform Reporting

As a digital platform operating in the EU and UK, OH-Stay is required to report affiliate earnings to the relevant tax authorities under EU Council Directive 2021/514 (DAC7) and the UK’s Digital Platform Reporting rules.

This means that OH-Stay will report the following information about you to the tax authority in your country of residence (or the country where you are tax-registered) on an annual basis:

● Your identity information (name, address, date of birth, TIN)

● Total commissions paid to you during the calendar year

● The number of transactions (bookings) on which commission was earned

● Your financial account identifier (IBAN or equivalent)

Reports are filed by 31 January each year, covering the previous calendar year. OH-Stay will provide you with a copy of the information reported at the same time.

You cannot opt out of DAC7 reporting. It is a legal obligation on OH-Stay as a platform operator. You are responsible for declaring your affiliate income on your personal or business tax return in accordance with the tax laws of your country of residence.

Important: OH-Stay does not provide individual tax advice. If you have questions about your tax obligations as an affiliate, please consult a qualified tax advisor in your country of residence.

 

6. Data Protection & GDPR

Affiliates who collect personal data in the course of promoting OH-Stay (for example, email addresses for newsletters, cookie consent data, or website analytics) are responsible for their own compliance with GDPR and all applicable data protection laws. OH-Stay is not a data controller for personal data collected by affiliates through their own websites or marketing channels.

Affiliates must ensure they have a lawful basis for processing any personal data they collect, provide clear privacy notices to users, and honour data subject rights (access, erasure, portability) in accordance with applicable law.

7. Disclosure Templates

The following templates are provided to help you comply with FTC and ASA requirements. Adapt them to your platform as appropriate.

Website & Blog Post Disclosure

This should appear at the top of the article, before any affiliate links are presented:

Affiliate Disclosure: This post contains affiliate links for OH-Stay.com. If you click through and make a booking or list your property, I may earn a small commission at no additional cost to you. These commissions help support this site and allow me to continue providing travel recommendations. Thank you for your support!

Social Media (Instagram, TikTok, X)

Social media disclosures must be immediate and visible. A hashtag buried at the end of a long caption is not sufficient.

Email Newsletter Disclosure

Since email is a direct marketing channel, the disclosure should appear near the top or immediately following the recommendation:

Note on Recommendations: I only recommend stays and platforms I trust. Please note that links to OH-Stay.com in this email are affiliate links, meaning I earn a commission on qualifying sign-ups or bookings.

 

8. Liability & Termination

Modification

OH-Stay reserves the right to change commission rates, programme terms, or this policy with 28 days’ written notice to affiliates. Notice will be sent to the email address registered on your affiliate account. Changes take effect at the end of the notice period unless you terminate your participation before that date.

Termination

Either party may terminate the affiliate agreement at any time with written notice. Upon termination:

● The affiliate must remove all affiliate links and OH-Stay brand assets from their website, social media, and marketing channels within 7 days.

● Commissions earned on bookings made before the termination date will still be paid, subject to the standard 30-day post-stay processing period and the chargeback/clawback provisions above.

● No trailing commissions will be paid on bookings made after the termination date, even if the original referral occurred before termination.

No Exclusivity

This affiliate programme is non-exclusive. Affiliates are free to promote competing platforms alongside OH-Stay. Similarly, OH-Stay may appoint multiple affiliates in the same market or territory.

No Warranty

OH-Stay does not guarantee specific earnings, conversion rates, or the continuous availability of the platform. The affiliate programme may be suspended or discontinued at any time with 28 days’ notice.
